Any infringement of these additional terms and conditions may culminate in the annulment of your reservations or the forfeiture of any payments made in connection with these reservations.
Miscellaneous
These Terms will be governed by the laws of the State of Maryland, without regard to conflicts of law principles. You willingly submit to the exclusive jurisdiction of the courts situated in the State of Maryland for the resolution of any disputes or questions arising from your use of this site and this Agreement. The relationship between you and CasitaMX is that of independent entities, and neither party nor any of their respective officers, agents, or employees will be deemed or construed as partners, joint ventures, fiduciaries, employees, or agents of the other. In the event that any part of these Terms is deemed invalid or unenforceable in accordance with applicable law, including disclaimers of warranties and limitations of liability, the invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely aligns with the intent of the original provision. The remainder of these Terms will remain in full force and effect. You may not assign, convey, subcontract, or delegate your rights, obligations, or duties under these Terms.
Use of the Site
You are forbidden from using the Site or its Content for any unlawful purpose or anything that contravenes the rights of CasitaMX or others.
Furthermore, you agree not to:
(i) Make false, speculative, or fraudulent inquiries, requests, or reservations.
(ii) Access, monitor, or copy any content or information on this Site using any method, including deep-linking, page-scraping, robots, spiders, or similar automated means.
(iii) Engage in actions that impose an unreasonable or disproportionately large burden on our infrastructure.
(iv) Employ any device, software, or routine to disrupt the proper functioning of the Site, any transactions being carried out on the Site, or any other person's use of the Site.
(v) Attempt to gain unauthorized access to the Site or systems or networks connected to the Site through hacking or any other illegitimate means.
No Warranties; Limitation of Liabilities
CasitaMX exerts reasonable efforts to maintain accurate and current information on the Site, though it makes no warranties or representations regarding its accuracy. The properties, information, products, and services presented on this Site may include inaccuracies or errors, which includes pricing errors. CasitaMX does not guarantee the accuracy of such information and denies any liability associated with errors or inaccuracies concerning the description of villas and other travel products displayed on this Site, including but not limited to pricing, photographs, lists of amenities, and general product descriptions. Much of this information is supplied by respective providers.
CasitaMX explicitly reserves the right to rectify any pricing errors on the Site and/or on pending reservations made at incorrect prices. In such instances, you will have the option to retain your pending reservation at the correct price or cancel your reservation without incurring any penalties. Property owners and other providers of travel or related services associated with the Site are deemed independent contractors and not agents or employees of CasitaMX. CasitaMX and its affiliates are not liable for the actions, errors, omissions, representations, warranties, breaches, or negligence of such providers, nor for personal injuries, death, property damage, or any other damages or expenses incurred as a result of these actions.
By offering travel products and services at specific destinations, CasitaMX does not affirm or warrant that travel to these locations is advisable or without risks, and disclaims liability for any damages or losses that may arise from travel to such destinations.
All information and services provided or referenced on the Site are presented "as is" and with all imperfections, and any risk associated with quality, performance, accuracy, and effort rests with the user. Under no circumstances shall CasitaMX, its affiliates, or their respective suppliers be liable for direct, indirect, punitive, incidental, special, or consequential damages that result from, or are in any way connected to, the use of or access to this site, or the delay or inability to use this site. This holds true even if CasitaMX, its affiliates, or any of their respective suppliers have been informed of the possibility of such damages.
In the rare event that CasitaMX, its affiliates, or their respective suppliers are found to be liable for any loss or damage arising from any of the occurrences detailed above, their liability will not exceed the greater of the total rental revenue you paid at the time of the incident or USD $150.00.
